Arabic Contract Signing: Domestic Worker Rights UAE
End-of-service documents for domestic workers are in Arabic. Neither the employer nor the worker understands the terms. What the papers actually say.
Your nanny has been with your family for three years. She’s moving on. The typing centre gives you both an Arabic document to sign. It’s the end-of-service settlement. The مخالصة. She can’t read it. You can’t read it either. You both sign because the typing centre says it’s standard. But neither of you knows what you just agreed to.
What the settlement says
The end-of-service settlement (مخالصة) for domestic workers is a legal release. It typically states:
- The worker’s employment period (start and end dates)
- Total salary paid and any outstanding amounts
- Gratuity calculation and payment confirmation
- A clause stating the worker has no further claims against the employer
- A clause stating the employer has no further claims against the worker
By signing, both parties waive the right to make future claims about the employment relationship. Getting a legal translation of the settlement before signing protects both sides. If the gratuity amount is wrong, or if salary was unpaid, signing this document makes it much harder to dispute later.
Why both sides benefit from translation
For the worker: She needs to confirm the amounts are correct. If the document states a lower gratuity figure than what she was actually owed, she should know before signing. Once signed, the مخالصة is her acknowledgment that she received everything owed.
For the employer: A properly understood settlement protects you from future complaints. If the worker later claims unpaid wages to MOHRE, a مخالصة that was translated and understood carries more weight than one signed blindly.
Other documents in the process
End-of-service isn’t just one document. The process may include:
- Visa cancellation form. Arabic form for cancelling the worker’s residence visa.
- NOC for transfer. If the worker is transferring to a new employer in the UAE, a no-objection certificate is needed.
- Final payment receipt. Confirming the last salary payment and any ticket reimbursement.
All in Arabic. All signed by people who may not read Arabic.
