A prenuptial agreement sets out how a couple will handle assets, debts, and other matters if the marriage ends. In Abu Dhabi, a prenuptial agreement can be submitted with the civil marriage application and notarised by the Civil Family Court. UAE Civil Marriage in Brief

Civil marriage is a secular personal-status route for foreign (non-UAE-national) couples. Abu Dhabi introduced it under Law No. 14 of 2021, registered through the Abu Dhabi Civil Family Court. A federal framework followed under Federal Decree-Law No. 41 of 2022, used by Dubai Courts and other emirates.

The two routes are not identical. Abu Dhabi is open to non-UAE nationals regardless of religion and has allowed non-residents to apply. The Dubai route is for non-Muslims, with at least one party resident in Dubai. Document requirements also differ. Because government rules can change, confirm the current requirements with the relevant court before you submit.

What stays constant for us is the translation rule: documents that are not in Arabic need an MOJ-certified Arabic translation.

A prenuptial agreement is rarely the only document in the file. The common set includes:

  • The prenuptial agreement — translated into Arabic before it is notarised, if drafted in another language.
  • Certificate of no impediment (CNI) or single-status certificate — Abu Dhabi does not list this as a universal requirement, but Dubai, an embassy, or your home authority may ask for proof you are free to marry.
  • Foreign divorce decree — required if you were previously married.
  • Death certificate of a former spouse — required if you were widowed.
  • CENOMAR — the Certificate of No Marriage Record for Filipino applicants, issued by the Philippine Statistics Authority.

The Sequence That Prevents Rejection

The most common mistake is translating too early. The order matters:

  1. Home-country authentication — notarisation or apostille in the issuing country.
  2. UAE Embassy legalisation — in the country that issued the document.
  3. UAE MOFAIC attestation — the final attestation stamp inside the UAE.
  4. MOJ-certified Arabic translation — produced only after the attestation stamps are on the original.

A translation produced before the attestation stamps exist will not show them. The receiving authority then rejects it, and the document has to be translated again. We check attestation status first so this does not happen.
